Nebraska State Laws and IID Requirements

Nebraska has both administrative and criminal penalties for DUI offenders, including license revocation and an interlock requirement for some offenders. When determining the penalties, the court considers the offender’s Blood Alcohol Content (BAC) at the time of the offense, if they have a prior offense on record, and if probation was granted. Some offenders may be able to get back on the road during their license revocation period if they install an ignition interlock device approved by the state

What Happens if I Fail to Complete or Refuse to Submit to a DUI Test in Nebraska?

There are still consequences for refusing to take a blood alcohol content test in Nebraska, and they are similar to those for a conviction. If a suspect refuses to test, they will have their license revoked for 180 days. This revocation could increase to 15 years if the offender has prior offenses.

How Can I Regain Driving Privileges in Nebraska?

Nebraska allows some offenders to get back on the road during their license revocation period, if they meet the following criteria:

      • 18 years old
      • Meet all criteria for reinstatement for all offenses (for example, if they have a non-alcohol offense that has also resulted in revocation)
      • Waive their right to an Administrative License Revocation hearing
      • Serve the required portion of the waiting period
      • Install an interlock from an approved provider and show proof of installation
      • Must surrender their Nebraska driver’s license, unless it has already expired

The court may require other criteria depending on the offense specifics.

What is an Ignition Interlock Device?

Ignition interlock devices use fuel-cell technology to keep roads safe. Here’s how:

      • The interlock device will require the driver to take a breath alcohol content test and pass before starting the car
      • The car won’t start if they fail the test
      • During most trips, the device will also request random retests to ensure the driver remains sober

How Long is an NE Interlock Device Required?

This is determined by the court, using statute as guidance. However, the court may increase the term depending on the event specifics.

The Cost of Interlock Devices in NE
