      Texas Ignition Interlock Laws and Compliance

      Texas is known for going big. However, when it comes to alcohol, going big can lead to serious consequences. The legal BAC (blood alcohol content) limit is .08 percent. If anyone is found driving under the influence with a BAC above that limit, they risk a variety of penalties. There are administrative and financial penalties including license suspension and fines. Some offenders may be able to regain their license if they agree to install an ignition interlock device. If an ignition interlock device is ordered, the Department of Public Safety (DPS) is notified via court order. Then, the offender has 30 days to install an IID from an approved provider. ADS is an approved provider, and all approved providers are listed on the Texas DPS website.

      In Texas, some drivers can receive a restricted ignition interlock device license, which allows them to drive as long as they install an ignition interlock device.

      What are the Penalties for a DWI in Texas?

      There are a variety of penalties for DWI offenders, which increase for repeat offenses.

      First DUI Offense

      • Up to $2,000 in fines
      • Up to 180 days in jail
      • License suspension for up to one year
      • Required to take a 12-hour DWI education course
      • May be required to install an ignition interlock device

      Second DUI Offense

      • Up to $4,000 in fines
      • One month to 12 months in jail
      • License suspended for two years
      • Required to take a 32 hour DWI education course
      • May be required to install an ignition interlock device

      Third DUI Offense

      • Up to $10,000 fine
      • Two to 10 years in jail
      • License suspended for up to two years
      • Required to take a 32 hour DWI education course
      • May be required to install an ignition interlock device

      The penalties increase if a minor is present.

      What Happens if I Refuse to Take a BAC Test in Texas?

      Offenders will also be punished even if they refuse to take a BAC test. They may still have their license revoked or suspended if they refuse a test when pulled over for a DWI incident.

      How Do I Regain Driving Privileges in Texas?

      Texas allows some offenders to regain their driving privileges if they meet certain criteria and agree to install an ignition interlock device from an approved provider.

      Other Criteria Include:

      • Offender should currently hold a Texas driver’s license that is not expired
      • Their driver’s license cannot be suspended, revoked, cancelled, or denied for any reason other than the DWI offense
      • Offender must submit the restricted interlock fee
      • Driver must have an IID installed by an approved provider like ADS
      • Show proof of appropriate insurance coverage
      • If a driver's license is suspended, in addition to the DWI requirement, offenders may be eligible for an Occupstional Driver's License. Check with the court or your attorney to see if you are eligible.
      • Offenders may have to serve out a required portion of their suspension, up to two years
      • May have to pay a $100 reinstatement fee

      Offenders will receive a court order if they are required to install an interlock device. Prior to September1, 2023, judges had discretion to require an IID. As of September, 1, 2023, they still have limited discretion. However, in DWI cases an IID is often required to obtain an ODL.

      What is an Ignition Interlock Device?

      An ignition interlock device, also referred to as a car breathalyzer, is a small device installed in your vehicle as a sobriety aid.

      • Offenders must test their Breath Alcohol Content (BrAC) using the device before they can start the vehicle. If their test has a result above the pre-set BAC limit, they will not be able to start the car.
      • Interlock devices also ensure continuous sobriety by requesting random retests during some trips.

      How Long is a TX Interlock Device Required?

      The length of time an offender must have an ignition interlock device installed for depends on the court and statute.

      In Texas, offenders are required to cover the cost of their ignition interlock device. The devices are leased, and typically cost between $2.50 and $3.50 per day.
