In Oregon, eligible drivers may be able to regain their driving privileges during the suspension period if they install an ignition interlock device, and meet other criteria. They can obtain a Hardship Permit that will allow them to use it.
What Happens if I Get a DUI in Oregon?
First DUI Offense
- 48 hours to one year in jail
- 80 hours of community service may be imposed in lieu of 48 hours in jail
- Up to $6,250 in fines depending on individual circumstances
- License suspended for one year
- Must install an IID to regain driving privileges, term is one year
Second DUI Offense
- 48 hours to one year in jail
- 80 hours of community service may be imposed in lieu of 48 hours in jail
- Up to $6,250 fine depending on individual circumstances
- License suspended for three years
- Must install IID to regain driving privileges, term is for two years
Third DUI Offense
- 90 days (if convicted of DUI at least two times in the past 10 years) to 5 years in jail
- $2,000 in fines if driver is not sentenced to prison time, up to $6,250 in fines depending on individual circumstances
- $250,000 in fines if driver is convicted of Class C felony
- License suspended permanently
- May be able to regain driving privileges with an IID, which will be required for two to five years depending on when prior offenses occurred
Refusing a breath test or field sobriety test will also result in consequences. Offenders who refuse a breath test will have their license suspended up to one year and also be fined up to $650.

How Do I Regain Driving Privileges in Oregon?
Oregon offenders who meet criteria are eligible to regain their driving privileges with a Hardship Permit. In order to get a Hardship Permit, the offender must install an ignition interlock device. Here is everything they need to do to qualify:

- Pay the $50 non-refundable application fee
- Pay a $75 reinstatement fee
- Obtain a recommendation from the convicting judge*

- Install an ignition interlock device for the duration of the Hardship Permit period
- Second-time offenders must wait 90 days into the suspension period to apply
- No hardship permit available for third offense and beyond
Not all offenders will be eligible for a Hardship Permit, depending on the circumstances of their offense.
